Audimas General Terms and Conditions / Regulations

  1. GENERAL PROVISIONS

 

1.1. The regulations of the Audimas e-shop (hereinafter “the Shop”) (hereinafter “the Regulations ”) apply to the Customer when placing an order in the Shop.

1.2. Audimas has the right to adjust the Regulations of the Shop. When the Customer makes a purchase in the Shop, the Regulations valid at the moment of placing the order (provided with the order) shall apply.

1.3. The Customer shall not be given the opportunity to place an order for goods in the Audimas Shop if he is not familiar with the Regulations of the Shop. In all cases, it is considered that the Customer has familiarised himself/herself with the Regulations and agrees with them if, before ordering the goods, he/she confirms acceptance of the Regulations by clicking “ACCEPT”. In cases where the Customer objects, either partially or wholly, to all or part of the Regulations, he/she must not place an order electronically with Audimas. Otherwise, the Customer is considered to have read and unconditionally agreed to all the Regulations of the Shop.

1.4. Audimas shall be released from any liability in those cases where the loss arises from the Customer’s failure to familiarise with the Regulations of the Shop, irrespective of the recommendations provided to him/her and his/her obligations, although he/she was given such an opportunity.

2.2. The Customer: is the person who is visiting the website as a potential or returning Customer.

  1. ORDERING AND PAYMENT PROCEDURE

 

3.1. When visiting the Shop’s website, a customer chooses the products he/she likes. On the basis of his/her choice, a shopping cart is created.

A Customer may purchase goods at the Shop if:

  1. The total price of all the items purchased by a Customer at the same time (per shopping cart) (including VAT and the discount applicable to the items at the time of purchase, if applicable) does not exceed EUR 2000.00;

or

  1. there are no more than three items (each item of a different size) of the same colour, title and design among all the items purchased by a Customer at the same time in the same shopping cart.

An order (shopping cart) that does not meet either of the above two requirements will not be processed (sold) at the Shop. Any order (shopping cart) that does not meet either of the above two requirements must be submitted to the wholesale department of UAB Audimas Brand [email protected]

3.2. After forming the shopping cart, the Customer must enter the data necessary to deliver the selected goods: his/her forename, surname, address to which the goods will be delivered, phone number, and additional information that may be important for the delivery of the ordered goods. UAB Audimas Brand confirms that the data provided by the Customer will be used exclusively for the purposes of sale and delivery of the goods, without violating the requirements for the protection of personal data provided for by the legal acts of the Republic of Lithuania.

3.3. Next, the Customer must choose one of the possible payment methods in the Audimas Shop. At the same time, the method of delivery of goods is selected from the possible delivery options offered by Audimas.

3.4. In the last window, all the data provided by the Customer are generated, before confirming which the Customer must make sure that the provided data are correct and meet his/her wishes. The Customer has the opportunity to correct incorrect data before sending the order to UAB Audimas Brand. The Customer is not allowed to confirm the order before he/she marks that he/she has familiarised himself/herself with and accepts the Regulations of the Shop. In case the Customer has not familiarised himself/herself with the Regulations of the Shop before selecting the goods, he/she must do so before confirming his/her order and the data provided in the order.

3.5. When the Customer confirms his/her order, it is sent to UAB Audimas Brand. The order is considered to have been placed from the moment it is received by UAB Audimas Brand. Then it is also considered that a contract has been concluded between the Customer and UAB Audimas Brand. However, such a contract is considered enforceable only from the moment when UAB Audimas Brand receives a confirmation of payment for the delivered goods from the bank selected by the Customer (where payment via on-line banking has been selected); when paying by bank transfer, the contract is considered enforceable when the Customer’s payment is received; when paying in cash upon delivery of the goods or by card at an automated parcel locker, the contract is considered enforceable from the moment when the Customer confirms his/her order in the Shop.

3.6. When the Customer submits his/her order, the Shop system automatically sends the Customer an e-mail indicating the ordered goods and the data provided by the Customer.

3.7. When UAB Audimas Brand receives a notice from the bank stating that the Customer has made a payment transfer to purchase goods from the Shop, a notice is sent to the Customer to the specified e-mail address. The moment of receipt of the notice from the bank is considered the starting moment of the execution of the contract between the Customer and Audimas.

3.8. The order submitted by the Customer is stored in the Shop database in accordance with the requirements of the applicable legal acts of the Republic of Lithuania for the term of storage of such data.

3.9. In all cases, it is considered that the Customer placing an order has familiarised himself/herself with and unconditionally agrees with all the Regulations of the Shop as well as with all other terms and conditions specified along with the order.

3.10. The contract is concluded and executed in the national language.

  1. WARRANTIES AND PRICING OF GOODS

 

4.1. The characteristics of each product are generally indicated together with each product in the Shop.

4.2. UAB Audimas Brand notes, and the Customer confirms that he/she is aware that the colour, shape or other parameters of the goods indicated in the Shop may be different the real size, shape and colour of the goods due to the specifics of the monitor used.

4.3. The Customer agrees that by placing an order in the Shop electronically, he/she undertakes to pay the price indicated in the order.

4.5. Prices in the Shop and in the order are indicated in the official national currency, as a VAT-inclusive amount.

4.6. UAB Audimas Brand sells goods that meet the terms and conditions specified in the order. In cases where the goods delivered to the Customer fail to meet certain requirements of the order, the Customer agrees, first of all, to immediately notify UAB Audimas Brand by phone or e-mail, and the latter undertakes to take all necessary steps to remedy any existing deficiencies if such have occurred though the fault of UAB Audimas Brand or third parties acting on its behalf. If UAB Audimas Brand fails to remedy the deficiencies within a reasonable term agreed with the Customer, the latter has the right to defend his/her rights in accordance with the procedure provided for in the Civil Code of the Republic of Lithuania.

UAB Audimas Brand obligations in respect of the goods:

 

4.6.1. UAB Audimas Brand undertakes to deliver the goods of the proper quality and in compliance with the requirements of the order.

4.6.2. UAB Audimas Brand undertakes to provide the Customer with the quantity of goods specified in the order. UAB Audimas Brand shall not be liable in cases where the quantity of the delivered goods is not accurate due to the fact that the Customer has incorrectly provided data in the order submitted to UAB Audimas Brand.

4.6.3. In all cases, UAB Audimas Brand provides the Customer with a range of goods that meet the criteria set out in the order.

4.6.4. In cases where the order provides for a certain set of items, UAB Audimas Brand undertakes to provide all the items included in the set of items.

4.6.5. The goods are delivered in packaging, taking into account their nature, in order to ensure that the goods are fit for their intended use.

  1. PROCEDURE AND TERMS OF PAYMENT

 

5.1. The Customer pays for the goods ordered by him/her in one of the ways specified in the Shop: by bank transfer, via on-line banking, paying by credit card or paying in cash.

5.2. If the Customer chooses one of the on-line payment methods, he/she undertakes to pay for the ordered goods immediately. If the Customer chooses to pay for the goods upon delivery, he/she undertakes to pay for them when accepting the goods. In other cases, the Customer loses the right to make claims for infringement of the terms of delivery of the goods because, according to the Customer’s order, the shipment of the goods begins to be formed only upon receipt of payment for the goods.

5.3. If the Customer chooses delivery via ZITICITY couriers, payment for the order is only possible in advance via on-line banking.

  1. RETURN OF THE GOODS

 

6.1. You can return any goods purchased in the Shop within 30 calendar days of receipt of the goods (except for underwear, socks and reusable masks) (Retailing Regulations, Chapter II, Section I).

  • Goods purchased in the e-shop can be returned within 30 days of receipt.
  • You can return a product purchased on-line only by filling in the electronic product return form in your Customer’s account. Returns are only possible through an LP express terminal, after submission of the application and approval by the administrator (within 1 working day). The sticker is generated automatically (within 1–2 hours).
  • Returns to physical “Audimas” shops are only accepted after filling in the electronic form and upon presentation of the packaged goods and the return order number.
  • Returns of goods of the proper quality is carried out in accordance with the procedure prescribed by the Retailing Regulations approved by Resolution No 697 of the Government of the Republic of Lithuania. In this case, the costs of delivery of the goods are not reimbursed.
  • Returns of goods from abroad is the responsibility of the Customer. Returns can be made by sending the package by registered mail with the parcel tracking number. To return or replace the goods, please fill in the return application form provided with the goods. Please return the goods being returned and the application form to: Raudondvario pl. 80, LT-47182, Kaunas, Lithuania. The product being returned must be unused, except for cases when it is being returned due to manufacturing defects. The product being returned must be in appropriate packaging (this section does not apply if the product being returned is defective). The product must be unused and the marketable appearance must be unaffected (i.e. with neat labels, protective films, etc.). 

 

6.2. The product being returned must be:

6.2.1. Unworn and without any external signs of wear (this item does not apply to the return of a defective product);

6.2.2. Packaged in suitable packaging that protects it from damage during transportation;

6.2.3. With all labels intended for the product and without loss of marketable appearance;

6.2.4. You can return the goods: FREE at any “Audimas” brand shop (not possible during quarantine). The money will be returned to your account within 14 days (Paragraph 2 of Article 6.22811 of the Civil Code of the Republic of Lithuania).

6.3. Defects of the goods

6.3.1. UAB Audimas Brand is responsible for defects of an item that become apparent within two years from the date of purchase of the item. (Part 6.338 of the Civil Code of the Republic of Lithuania)

6.3.2. Your opinion is important to us! If you are not satisfied with the quality of the purchased product, please contact any “Audimas” shop. We will examine your claim and provide a response within 14 days. When submitting a claim, make sure to attach a document proving the purchase (invoice, receipt or payment statement). For any questions concerning the quality of products, please phone +37068286901 (on working days, from 8 a.m. to 5 p.m.).

6.3.3. If the Customer is not satisfied with the final response of UAB Audimas Brand, he/she may apply for out-of-court settlement of consumer disputes to the State Consumer Rights Protection Authority (address: Vilniaus g. 25, 01402 Vilnius, Lithuania, e-mail: [email protected], phone: 852626751, website: www.vvtat.lt) in its territorial divisions in the counties, or fill in the application form on the EGS platform: http://ec.europa.eu/odr/.

6.3.4. The State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, www.vvtat.lt) is competent to settle consumer disputes in accordance with the out-of-court procedure.

 

  1. DELIVERY OF THE GOODS

 

7.1. The Customer may choose different ways of delivering the product. Receipt of the product depends on the service selected by the Customer.

7.2. Normally, goods are delivered to the address indicated by the Customer within 3–7 working days from receipt of payment for the goods and transportation of the goods, provided that the goods are available at UAB Audimas Brand warehouses. UAB Audimas Brand does not guarantee that the goods in all cases will be delivered within the time limits indicated in the previous sentence, especially when the ordered goods are not available at UAB Audimas Brand warehouses.

7.3. When ordering goods with delivery by a ZITICITY courier every day by noon, the order will be delivered in the evening of the same day. Parcels are delivered from 6 p.m. to 10 p.m.

Attention! During the season sales, the delivery term may take 2–5 days longer than the envisaged usual delivery term (3–7 working days)

 

7.3. The exact date and time of delivery of the goods is indicated in the notice provided by UAB Audimas Brand to the Customer by the e-mail address indicated by the Customer in the registration form. Accordingly, the Customer, who has concluded a contract of purchase and sale, undertakes to check the said e-mail box every day until the note of delivery of the goods is received.

7.4. Before placing an order, the Customer must check the accuracy of the provided contact information to avoid misunderstandings or delay in the delivery of the product. UAB Audimas Brand shall not be liable for any misunderstandings or delay in the delivery of the product if the delay or misunderstandings have occurred due to inaccurate or incorrect data provided by the Customer during the formation of the order.

7.7. In case the product reaches the Customer in an improper condition or in a package that is not tightly closed, the Customer must inform the e-shop by e-mail [email protected] or phone +37062078167.

 

  1. FINAL PROVISIONS

 

8.1. UAB Audimas Brand and the Customer undertake not to disclose any terms of this document to any third parties, except to the state, governmental and law enforcement authorities, which are entitled to receive such information in accordance with the procedures prescribed by laws.

8.2. All disputes arising out of or in connection with the contract of purchase and sale between the Customer and UAB Audimas Brand shall be settled by means of negotiations. In case of failure to reach agreement, disagreements shall be resolved in accordance with the procedure prescribed by the legal acts of the Republic of Lithuania.
